Terms of Use

1. Operator and scope

PopPose is operated by Morphon, LLC, a Delaware limited liability company, at 131 Continental Dr, Suite 305, Newark, DE 19713, United States. Software obtained through the App Store is also licensed under Apple’s Standard End User License Agreement. These Terms primarily govern your PopPose account, cloud sync, AI features, creation credits, and subscription services.

2. Eligibility and accounts

You must be at least 13 and meet the minimum digital-consent age where you live. If you have not reached the age of legal majority, you need a parent or guardian’s consent. Provide accurate information, protect your Apple account and device, and take responsibility for activity under your account. Do not sell, transfer, or share an account except where we expressly permit it. Notify us promptly of unauthorized use.

3. Service and changes

PopPose provides toy photography, collection management, on-device and AI cutout, cloud sync, AI video generation, sharing, and export. Features may vary by device, operating system, region, network, Apple, or third-party model availability. We may adjust features for security, legal compliance, performance, or product improvement, but will not retroactively remove purchased rights that applicable law requires us to preserve. Maintenance or events outside reasonable control may temporarily interrupt service.

4. Your content and license

You retain rights you lawfully hold in uploaded photos, collection text, and generated results. You grant Morphon, LLC a non-exclusive, worldwide, royalty-free license limited to hosting, copying, transmitting, formatting, and processing content to provide features you select. That license ends when the relevant content is deleted from the service, except for legally retained backups or records. You represent that you may submit and use the content without infringing intellectual-property, privacy, publicity, or other rights.

5. AI features and output

Standard Cutout runs on-device. When you choose AI Cutout or video generation, images and parameters are disclosed to providers as described in the Privacy Policy. AI output is probabilistic and may alter color, proportions, text, trademarks, or toy details, may be inaccurate, and may resemble other output. Review output and applicable rights before publishing, selling, or using it commercially. Unless the law requires otherwise, we do not guarantee a particular model, generation time, or fitness of output for a specific purpose.

6. Purchases, creation credits, and subscriptions

iOS digital features are sold through Apple In-App Purchase. The localized price, billing period, trial, and renewal information shown at purchase controls. Apple charges an auto-renewable subscription to your Apple ID within 24 hours before the current period ends unless you cancel in Apple ID subscription settings at least 24 hours before renewal. Deleting your PopPose account or the app does not cancel an Apple subscription.

Monthly and annual PRO subscriptions grant the creation credits shown at each verified renewal and unlock premium storyboards during an active term. Credits are not currency and cannot be transferred, redeemed for cash, or combined across accounts. An AI task consumes the amount shown before creation; failures confirmed as service or provider errors are refunded under the service rules. Apple handles applicable refunds, revocations, and billing disputes; after a refund or revocation, we may remove related entitlements or unused credits. Non-waivable consumer rights remain unaffected.

7. Acceptable use

You may not use PopPose to:

• break the law, infringe intellectual-property, privacy, or publicity rights, or harass or deceive others;
• upload malicious code or probe, bypass, or disrupt authentication, rate limits, credits, content review, or security controls;
• use automation, bulk accounts, or other means to consume model, storage, or network resources abnormally;
• generate or distribute unlawful content or impersonate PopPose, Morphon, LLC, Apple, a provider, or another person or organization; or
• resell, copy, reverse engineer, or exploit the service or non-public interfaces without permission, except where applicable law expressly permits it.

8. Suspension, termination, and deletion

We may restrict or suspend affected features when we reasonably believe an account creates a security risk, fraud, illegality, infringement, or a serious Terms violation. Where practical, we will explain the reason and offer a way to appeal. You may delete your account in app settings at any time. After termination, service access ends, but payment obligations, accrued rights, liability limits, dispute terms, and provisions that by their nature should survive remain effective.

9. Third-party services

Apple, Cloudflare, Replicate, Atlas Cloud, and underlying model providers have their own terms and privacy practices. We are responsible for selecting and integrating our providers but do not control their independent services, store policies, or global networks. A third-party interruption does not remove obligations the law places on us; failed tasks attributable to PopPose are handled under applicable product rules.

10. Disclaimers and limitation of liability

To the extent permitted by law, the service is provided “as is” and “as available,” without warranties not expressly stated in these Terms. Morphon, LLC is not liable for indirect, incidental, special, punitive, or consequential damages or loss of data, profit, or goodwill. Our aggregate liability relating to the service will not exceed the greater of the amount you paid PopPose during the twelve months before the claim arose or US $100. These limits do not apply to fraud, willful misconduct, personal injury, liability that cannot lawfully be limited, or non-waivable consumer rights.

11. Governing law and disputes

Except where non-excludable consumer-protection or other mandatory law where you live requires otherwise, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. You and Morphon, LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware. This clause does not limit any non-waivable rights, complaint channels, or venue available under the law where you live.

12. General and contact

If any provision is unenforceable, the rest remains effective. A delay in enforcing a right is not a waiver. You may not assign this agreement without our written consent; we may assign it with the service in a corporate reorganization or business transfer, subject to legally required notice. Material changes will update the date above and be communicated reasonably. If you disagree, stop using the affected service.
